The machine-readable notice includes exclusion grounds for criminal organisation, corruption, fraud and other standard mandatory exclusion grounds. The bidder or its management, supervisory or representative persons must not have final convictions within the last five years for these offences, unless the conviction period has expired. If an exclusion ground exists, the bidder may submit evidence of self-cleaning where allowed. The notice also asks for confirmation that tax and social security contributions are paid. Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. The ESPD mainly contains exclusion grounds and confirmations of bid compliance. When submitting the bid, the bidder must confirm that the bid complies with the procurement documents, that green electricity is offered, that the guarantees of origin will be cancelled for the contracting authority’s consumption if the bidder is successful, and that, where applicable, an explanation of equivalence and supporting evidence have been provided. If the bidder’s representatives are not shown in the commercial register, a list of such persons must be submitted with their names, personal identification codes and the basis of representation. In the case of a joint bid, a power of attorney signed by all joint bidders must be attached to the bid documents.
