Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if insolvency or liquidation proceedings have been opened against it, or if its business has been suspended or it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after notice. The notice also requires confirmation that the bidder has no exclusion grounds under section 95(1)(1–3 and 5) of the Public Procurement Act, taking into account section 95(2), and that the bidder is not a related person to the technical consultant advising the apartment building reconstruction. If the contracting authority cannot verify the absence of exclusion grounds from public registers, the bidder may be asked to submit supporting documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or adjoining water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, who may prove their competence with an equivalent document.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro.
The bidder must be able to provide, for the construction period, a first-demand guarantee letter or equivalent security in the amount of 5% of the construction contract value excluding VAT. If the contract is signed before the security is provided, the security must be submitted no later than 10 calendar days after signing.
Within the last 60 months, the bidder must have completed at least one equivalent construction project with a value of at least half of the estimated contract value. An equivalent project means the construction, extension, or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery ventilation system, or the construction or reconstruction of a new heating system. The bidder must provide the project name, building details, execution period, value, and information on the scope of works.
The team must include a suitably qualified project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a competent person. The project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification; the site manager must have a level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification with the relevant specialisation; the water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialisation; and for electrical works there must be at least a B-class competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capabilities of other persons, signed confirmations from those persons allowing participation in contract performance must be attached to the bid.
The machine-readable notice did not include precise compliance requirements beyond the above; the tender documents must be checked for any additional forms or proofs.
