Compliance requirements
The bidder must confirm the standard exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, and terrorist offences. The notice also includes the usual self-cleaning option: if an exclusion ground applies, the bidder may explain measures taken to restore reliability, where allowed by the procurement rules or the tender documents. The machine-readable notice did not include the full list in one place, so the exact exclusion grounds and any recovery conditions must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must show a net turnover in the field of building works of at least EUR 100,000 in each of the last 2 financial years ended by the start of the procurement procedure. If the contracting authority cannot verify this from public registers, an extract from the annual accounts or another proof must be submitted.
As for previous experience, the bidder must have properly performed at least 2 construction contracts in the 24 months before the start of the procurement procedure, each with a separate value of at least EUR 30,000 excluding VAT. Information is required on the other contracting party, contract duration, contract value, scope of work and proper performance; if the contract was a public procurement, the procurement register reference number must also be provided.
The bid must comply with the procurement documents and conditional bids are not allowed. The bid price must be submitted in the required structure. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bidder must also confirm that the bid complies with the requirements, that any equivalence has been explained where needed, and that supporting evidence has been attached. The contracting authority also requires confirmation that the bidder will not use subcontractors subject to replacement during contract performance and will provide the names, contact details and legal representative details of subcontractors known by the start of performance.
