Compliance requirements

The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or other forms of trafficking in human beings, and other legally listed grounds. If an exclusion ground exists, the bidder may need to show self-cleaning measures where allowed. The exact list and any recovery/self-cleaning options must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must prove that, during the 36 months before the start of the procurement, it has performed at least 1 catering contract with a duration of at least 12 months, the subject of which was the provision of school lunches in a school for at least 200 pupils or school staff. A list of completed contracts must be submitted, including the contract partner’s name and contact details, a description of the contract subject, the number of people catered for, the contract award and performance dates, the contract period, and, for a public contract, the reference number. If the contract was performed only partly within the reference period, only the part that had been delivered and accepted by that time is counted. In addition, a 4-week sample menu for pupil catering must be submitted. During contract performance, at least 20% of the total raw materials used each month for school meal preparation must come from organic production, and this must include different product groups at least once a month, including meat, eggs, dairy products, cereal products, and fruit and vegetables. The bidder must also confirm that the organic suppliers are registered in the organic farming register and must provide the names, registration codes and contact details of the companies or persons from whom the organic raw materials will be sourced during contract performance. To submit a tender, the bidder must have visited the site and the bidder’s representative must have signed the site visit record. In the case of a joint tender, an authorised representative must be named. Conditional tenders are not allowed.
