Compliance requirements
The bidder may be excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise suspended in a similar situation under the law of its country of establishment. The bidder may also be excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving notice of the exclusion ground. The notice also refers to the general exclusion grounds under the Public Procurement Act and to the requirement that the bidder’s average wage must not have been below 70% of the average wage in the relevant sector during the comparison period, unless the bidder has no employees. For foreign bidders, equivalent evidence from the competent authority in the home country is accepted.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the previous financial year must be at least EUR 1,000,000 per year. The bidder must also have completed at least 3 comparable construction works during the 60 months before the start of the procurement procedure; comparable works are defined as the construction, extension or full-building reconstruction of buildings as the main contractor. The team must include competent persons in the following roles: project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and the person carrying out electrical works. Specific professional or competence requirements apply to each role and must be evidenced where necessary. The bidder must have the required trade register entries for construction activities and a separate registration for electrical works; for a foreign bidder, equivalent evidence may be accepted. In addition, the bidder must have a quality management system and an environmental management system in the construction field that comply with EVS-EN ISO 9001 and EVS-EN ISO 14001 or equivalent standards. The bidder must be able to provide a construction-period security, confirmed by a credit or financial institution, in the amount of 5% of the construction contract value; if it has not been provided before contract signature, it must be submitted no later than 10 calendar days after signature. The bid must also include the required evidence or free-form explanations if requested by the contracting authority.
