Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the specific exclusion grounds referred to in the notice. In addition, the bidder must confirm that its average wage level during the reference period was above 70% of the average wage in the relevant field, and must provide a Tax and Customs Board extract or an equivalent certificate from the competent authority in the bidder’s country of establishment. In a joint bid, the proof must be submitted for each joint bidder. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the economic activities register under the activity area “Construction” with the following activity types: general construction, indoor climate systems, and building internal water supply or sewerage systems. For electrical works, the bidder must also have a notice in the register under the activity area “Electrical works” for construction, including installation, of an electrical installation. For a foreign bidder, the registration requirement does not apply, but competence must be demonstrated with an equivalent proof where relevant.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated value of the contract, excluding VAT. In a joint bid, turnover cannot be aggregated to meet this requirement; it is sufficient if at least one joint bidder meets it on its own.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project as the main contractor. An equivalent project means the construction, extension, or full reconstruction of a building, and it must have included at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. For the reference project, the bidder must provide the project name, timing, value, details of the work content, and proof through a use notice, occupancy permit, or a handover-acceptance certificate.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person involved in electrical works with the required competence. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The project manager must have at least level 6 construction engineer qualification with a specialization in building construction, or level 6 construction manager qualification with a specialization in general construction. The site manager must have at least level 5 construction work manager qualification with a specialization in general construction works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification with a specialization in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification, or level 6 construction manager qualification with the relevant specialization. For electrical works, the person involved must have at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations.
The bidder must confirm that it accepts the possibility of providing a performance-period guarantee of 5% of the contract value no later than the contract date or within 10 calendar days after contract signature. As an alternative, the corresponding amount may be deposited in the contracting authority’s or a notary’s account, provided that the beneficiary remains the entitled party throughout the construction period.
The machine-readable notice did not include any more precise compliance requirements; these must be checked in the official tender documents and tender documents are to be reviewed for the exact forms and proofs required by the bidder's submission. The bid form, joint-bid power of attorney, representation authority, trade secret declaration, equivalence evidence, and confirmations for team members must be submitted where applicable, but the exact completion details should be checked in the tender documents and official tender details if needed.
