Compliance requirements
The tender documents include mandatory exclusion grounds. The bidder must confirm that neither the bidder nor its management, governing or supervisory body members, nor persons authorised to represent, decide for, or control the bidder, have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or that any disqualification period in the judgment has already expired. The bidder may also need to confirm self-cleaning measures where applicable. The exact exclusion grounds and confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must prove at least two previous contracts performed between 01/01/2022 and the date of publication of the contract notice, where each contract concerned Microsoft SharePoint maintenance or development services. Each contract must have a value of at least EUR 100,000 excluding VAT. If a contract started before or ended after that period, the bidder must show that at least EUR 100,000 worth of the contract was performed during the relevant period. The bid must include a list of the contracts with dates, values and the other contracting parties, and if needed an explanation of how the contracts meet the requirement. If the bidder relies on the capacities of other entities, the bidder must also provide the required information about those entities, and the contracting authority will check their exclusion grounds and qualification. For compliance requirements, a joint bid power of attorney must be submitted if the bid is joint, and form-compliant CVs must be provided for the IT project manager, developer, analyst and IS quality specialist; a copy of the IT project manager’s higher education document must also be included. The bidder must confirm compliance with the tender documents, the clarification and proof of equivalence where relevant, and the sanctions requirements.
