Compliance requirements
The bidder must confirm that there are no exclusion grounds under Section 95(1)(1)–(3) and (5) of the Public Procurement Act, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business has not been suspended or is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee or environmental charge arrears, or social security contribution arrears, under the law of its country of establishment. The bidder must confirm that its employees’ average wage during the reference period was above 70% of the average wage in the same period in the relevant field for the contract. The reference period is six calendar months, ending with the calendar month before the month in which the procurement procedure was started. The bidder must provide a Tax and Customs Board statement or equivalent proof from the competent authority in its home country; in a joint bid, proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must be registered in the Estonian Business Register for construction activities covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations; this registration requirement does not apply to a foreign bidder, but equivalent competence must be proven.
The bidder’s net turnover for the financial year preceding the financial year before the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; it is sufficient if at least one joint bidder meets the requirement on its own.
The bidder must provide details of at least one equivalent construction project carried out within the last 60 months, where the bidder acted as main contractor for the erection, extension or full-building reconstruction of a building and the work included at least construction or reconstruction of the building’s load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a new heating system. The bidder must provide the project name, building details, execution time and value, and explain which of the listed works were included.
The team must include a project manager with at least Level 6 construction engineer qualification specialising in building construction, or Level 6 construction manager qualification specialising in general construction. There must also be a site manager with at least Level 5 construction foreman qualification specialising in general construction works. In addition, the team must include a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and, for electrical works, a person with the relevant professional or competence certificate. For foreign bidders, equivalent competence is sufficient.
The bidder must have a quality management system in the construction field that meets at least EVS-EN ISO 9001, and an environmental management system that meets at least EVS-EN ISO 14001, or equivalent requirements. A copy or proof of these systems must be provided.
The machine-readable notice did not include precise requirements for all compliance details; the official tender documents must be checked for the exact forms and confirmations required. The bid must be unconditional and must confirm acceptance of all base document terms. The bidder must use the beneficiary’s bid form, and if the bid is submitted by an authorised representative or as a joint bid, the relevant power of attorney must be attached. If the bid contains trade secrets, the bidder must identify them and explain why they are confidential. Any reference to a specific source, process, brand, patent, type, origin or production method must be treated as including “or equivalent”, and equivalent proof must be attached where relevant. If team members used to prove competence are not the bidder’s employees or are not listed in a public register as competent persons, each such person’s written consent to participate in contract performance must be attached.
