Compliance requirements
The contracting authority will exclude a bidder or candidate if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent or control the company, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or related incitement, aiding or attempt, money laundering, or terrorist financing. Exclusion also applies if such persons have been convicted for enabling work for a foreign national staying in the country illegally, or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate. The bidder is also excluded for offences related to illegal use of child labour or human trafficking, for tax, fee or environmental charge arrears, or for tax or social security contribution arrears under the law of the bidder’s country of establishment. A contract will not be awarded if it would breach an international sanction or a sanction of the Government of the Republic under the International Sanctions Act. The bidder must provide a confirmation that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must prove its ability to perform the contract in one of two ways: either by showing that it has at least EUR 100,000 in free financial resources available, or by showing that as of 31 March 2026 its equity is at least 25% of the balance sheet total, but not less than EUR 100,000. In the first case, a bank statement confirming the availability of free funds must be submitted. In the second case, a free-form statement together with a balance sheet signed by the bidder’s legal representative as of 31 March 2026 must be submitted. The bidder must have, within the previous 60 months, experience in constructing a gravity sewer and water pipeline in a single trench under an asphalt-covered street over a section of at least 150 metres, where the outer diameter of the gravity pipe is at least De 200 mm and the outer diameter of the water pipeline is at least De 110 mm. The bid must name the bidder’s authorised representative and the responsible representative during contract performance, i.e. the contractor’s project manager. Experience in constructing a public sewer pumping station of at least De1600 mm must also be demonstrated, including the client’s details, the location of the site, the time of performance and confirmation that the works were carried out properly and in accordance with good construction practice. If the bidder relies on a subcontractor’s references, that person must personally perform the relevant part of the contract. The bid must also include the price form and confirm that the bid complies with the tender documents; conditional bids are not allowed.
