Compliance requirements
The bidder must confirm that neither it nor its management, supervisory or controlling body members, procurators or other authorised representatives have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud or other exclusion grounds listed in the ESPD.
If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted.
The compliance conditions also include a sanctions requirement: the bidder confirms that it will not involve subcontractors or suppliers accounting for more than 10% of the contract value who are citizens, residents or entities established in the Russian Federation, or persons or entities owned by or acting on behalf of such persons or entities. The contracting authority may reject a tender if the resulting contract would be void due to sanctions rules.
The machine-readable notice did not include precise exclusion grounds; these must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the last 3 procurement procedures must be at least EUR 130,000 per year. If the eRHR data are not available, the turnover must be provided in the ESPD.
The bidder must have performed at least 2 similar sales and installation contracts in the 36 months preceding the start of the procurement, each worth more than EUR 120,000 excluding VAT. Similar contracts are office furnishing contracts. A list of the contracts must be provided with the contract partners, subject, value, duration and other required details; if the contracts were awarded through public procurement, the procurement reference number must also be included.
The tender must comply with the procurement documents and, where necessary, equivalence explanations and evidence must be attached. The technical proposal must be submitted according to Form 5, and the tender price must be submitted in the eRHR price form and in Form 4. If an equivalent product or material is offered, all required quality evidence and an introduction of the equivalent product must be attached.
The person submitting the tender must have the right of representation. If this is not shown in the register card, a power of attorney must be submitted.
The wood used in the furniture must come from legal sources, and proof of origin must be provided upon handover of the furniture, for example an FSC certificate, FLEGT or CITES licence.
