Compliance requirements

The bidder and its management body members must not have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud, or any other exclusion grounds listed in the procurement documents. The same applies to terrorist offences, money laundering, tax debts, professional misconduct and other exclusion grounds stated by law or in the procurement documents, where applicable. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures if permitted. Where necessary, the ESPD must also include the date, reason, convicted person, duration of exclusion and references to electronically available evidence. In addition, the bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus and that it does not use subcontractors or suppliers established in the Russian Federation for more than 10% of the contract value, nor rely on their capacities for qualification purposes.

Qualification criteria and exclusion grounds

The bidder must demonstrate financial and technical capacity. The average net turnover in the contract-related field for each of the last three financial years ended by the start of the procurement must be at least EUR 190,000 for the period 01/01/2023–31/12/2025. The bidder must submit the turnover data on Form II. The bidder must have at least 3 years of experience in supplying goods similar to the subject of the contract. Within the 36 months before the start of the procurement, the bidder must have completed at least 3 contracts related to similar goods. Form III must be submitted with a list of the contracts, including the subject matter, performance period, value and the other contracting party. The tender must comply with the conditions and requirements set out in the procurement documents. The bidder must submit the participation application on Form I. If the tender is signed by a person whose authority does not appear from the commercial register extract, a power of attorney must be provided. In the case of a joint tender, an authorised representative must be appointed and a joint bidders’ power of attorney must be attached. The tender price must be submitted on Form IV according to the required structure. If the bidder relies on evidence or documents, they must be attached as files proving compliance with the requirements.
