Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must confirm that it does not engage subcontractors or suppliers for more than 10% of the contract value if they are citizens, residents or companies established in the Russian Federation, or persons or entities linked to them as described by the sanctions rules. The bidder must also confirm that it does not engage a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act. In the case of a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also indicate the scope and justification of any trade secret and confirm that the tender complies with the conditions set out in the procurement documents.

Qualification criteria and exclusion grounds

The bidder must provide in the ESPD details of at least three travel service contracts performed within the 36 months preceding the start of the procurement. Each contract must have had a value of at least EUR 300,000 excluding VAT. If a framework agreement is submitted as a reference, it must also have been properly performed during the same period and at the same value. On request, the successful bidder must provide additional explanations, data or documents proving proper performance of the reference contracts. By the time the tender is submitted, the bidder must be an IATA-accredited ticketing agent and provide a copy of a valid certificate or a web link if compliance can be verified from a public source. At least 2 travel consultants must participate in performance of the framework agreement; they must speak Estonian and English, have at least 3 years of experience in providing travel services, be accredited by IATA or an equivalent organisation, and hold a valid CTC certificate or an equivalent qualification. The bidder must submit their details on Form I. The bidder must have free Estonian- and English-language 24/7 customer support available by phone, e-mail and other agreed channels, with operational access to booking systems. The bidder must also have a crisis plan showing how it will handle possible crisis situations during service delivery and how it will support the contracting authority and service users in those situations. The tender must comply with the tender documents and, where necessary, equivalence must be explained and supporting evidence attached.
