Compliance requirements
The bidder and its management bodies must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorism, human trafficking, tax-related grounds, or other exclusion grounds listed in law. If an exclusion ground exists, the bidder may in certain cases submit evidence of self-cleaning measures, if this is allowed in the contract notice or procurement documents. The machine-readable notice did not include precise exclusion grounds; they must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of its country of establishment, and the contracting authority may require proof of registration.
The bidder’s average net turnover for the last three completed financial years must be at least EUR 500,000 for the period 01/01/2023–31/12/2025. If the bidder is not established in Estonia, it must submit extracts from its 2023–2025 annual accounts showing the net turnover. If the bidder relies on the resources of another company, the necessary details for that company must also be provided; the bidder and the other company are jointly liable for performance of that part of the contract.
The bidder must have professional liability insurance in the amount of EUR 50,000, and supporting evidence must be provided upon the contracting authority’s request.
For managing the landscaping and maintenance works, the bidder must involve a responsible person with a professional qualification of landscape builder level 4 or gardener level 4, or an equivalent certificate at EQF level 4 for a bidder established outside Estonia. That person must have at least one previous experience as a responsible person in a landscaping contract worth at least EUR 100,000 excluding VAT. The work experience must be stated with month-level precision. A CV signed by the specialist and documents or data proving the professional qualification must be submitted.
The bid must confirm compliance with the procurement documents, and the required bid price structure and cost schedule form must be completed. If the bid is a joint bid, a power of attorney for the joint bidders must be submitted. If subcontractors are used, the same qualification and experience requirements apply to the specialists involved, and the specialists named in the bid must be used during performance; any replacement is allowed only with an equivalent specialist and with prior approval from the contracting authority.
