Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds listed in the tender documents. If an exclusion ground applies, the company may in some cases provide evidence of self-cleaning to restore reliability. The machine-readable notice did not set out all exclusion grounds in full; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 750,000. Joint bidders may combine their figures. To prove compliance, the bidder must provide the turnover data in the ESPD and, on request, an extract from the latest annual accounts or other evidence. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, where required, its consent; the other company is jointly and severally liable for the part of the contract performed using its resources. As regards technical and professional ability, the bidder must submit a list of major road construction contracts for publicly used roads that meet the contracting authority’s specified characteristics and were completed within the 60 months preceding the start of the procurement, together with, on request, client confirmations or other evidence that the works were performed properly. The machine-readable notice did not include precise other selection or compliance requirements; these must be checked in the tender documents.
