Compliance requirements

The ESPD contains the usual exclusion grounds: participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, commission of a terrorist offence or related offences, fraud, money laundering, tax arrears, unpaid social security contributions, labour-law breaches and other grounds provided for under the Public Procurement Act. The bidder must answer these questions with yes/no responses and, where required, provide the date, reason, person concerned, exclusion period and a description of self-cleaning measures. If an exclusion ground applies, the bidder may submit self-cleaning evidence where permitted.

Qualification criteria and exclusion grounds

The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. As compliance requirements, the bidder must confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, and that evidence of equivalence has been attached. The supplied goods must carry at least a 12-month warranty. The bid price must be submitted in the structure set out in the tender documents. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
