Compliance requirements
The bidder must confirm that neither the bidder nor its management, representative or supervisory body members have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD, or that any resulting exclusion period no longer applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and must provide origin documents. The bidder must also confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value who are Russian nationals, residents or entities established in the Russian Federation, or who are more than 50% owned by such persons or entities, or act on their instructions.
Qualification criteria and exclusion grounds
The bidder must submit the application for participation in the procurement on Form II. In the case of a joint tender, the bidders must appoint one representative from among themselves and submit a power of attorney for the joint bidders in accordance with Form I. The bidder must submit documents proving the right to represent the offered software and the right to sell it in Estonia; if the manufacturer is not established in the European Union, a document issued by the manufacturer’s authorised representative must be provided, together with any further sub-delegation documents if applicable. The tender must comply with the technical requirements set out in the procurement documents and in Annexes 1 to 3, and the bidder must confirm that the price form is completed according to the required structure. The bidder must also provide a list, with reasons, of the information held by TEHIK that is strictly necessary for proper contract performance. If any precise qualification or suitability requirements are only set out in the procurement documents, they must be checked there.
