Compliance requirements

The bidder must confirm that neither the bidder nor its management, supervisory or controlling body members, prosecutors or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of trafficking in human beings, fraud, commission of a terrorist act or offences related to terrorist activity. The bidder must also confirm that no other exclusion grounds set out in the tender documents and the Public Procurement Act apply. If an exclusion ground exists, the bidder may in certain cases provide evidence of self-cleaning measures to restore reliability. The contracting authority has also set subcontractor-related confirmations: subcontractors subject to replacement may not be used in performance of the contract, and subcontractors or suppliers from the Russian Federation, Russian residents or entities established in Russia, or persons controlled by them, may not be engaged for more than 10% of the contract value.

Qualification criteria and exclusion grounds

The bidder must demonstrate technical and professional capability through at least one previous works contract completed within the 60 months before the start of the procurement procedure. The requirement can be met in two alternative ways: either by fully constructing or reconstructing drainage system regulating-network ditches of at least 50 km, culverts with a diameter of at least 400 mm in at least 50 units, and roads of at least 9 km or 45,000 m2; or by fully carrying out drainage system renewal or maintenance covering at least 250 km of ditch restoration, maintenance of at least 250 culverts with a diameter of at least 400 mm, and road construction or reconstruction of at least 9 km or 45,000 m2. The bidder must enter the relevant contract data in the ESPD and, upon the contracting authority’s request, provide a list of major works and the clients’ confirmations that the works were performed properly. The bid must comply with the tender documents, conditional bids are not allowed, and any equivalence must be explained and evidenced. In addition, the price form, proof of bid security, and where applicable the joint bidders’ authorisation and other required documents must be submitted.
