The bidder must confirm that neither it nor members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm the payment of taxes and social security contributions and that the offered goods are not subject to sanctions and that the ownership and control requirements are met in accordance with the tender documents.

The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. For compliance, the bidder must submit a technical offer showing that the offered equipment meets the technical specification, including the manufacturer, model and all required technical data. If the bid is signed by a representative whose authority does not appear in the register, a power of attorney must be submitted. In the case of a joint bid, a joint bidders’ power of attorney and ESPDs for all joint bidders must be provided.
