Compliance requirements
The bidder is excluded if it is bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, or otherwise suspended in a similar situation under the law of its country of establishment. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment, unless the debt has been deferred, paid, or will be paid/deferred within 10 calendar days after receiving notice of the exclusion ground. The notice also requires confirmation that the bidder is not subject to the exclusion grounds listed in the Public Procurement Act sections referred to in the document, that the average wage of its employees is not below 70% of the sector average for the relevant six-month comparison period, and that the bidder is not a related person with the technical consultant advising on the apartment building reconstruction. If the bidder does not submit the required evidence and the contracting authority cannot verify the absence of the grounds from public registers, the bidder must provide the documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder's net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated value of the contract, excluding VAT. During the 60 months before the start of the procurement procedure, the bidder must have completed at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means construction, extension, or full-building reconstruction as the main contractor, and it must have included at least the construction or reconstruction of the building's load-bearing structures and external envelope, mechanical ventilation with heat recovery, and a new heating system. By submitting the bid, the bidder must be able to provide, by the date of signing the construction contract, a performance guarantee amounting to 5% of the contract value; the guarantee may also be provided by depositing the money on the contracting authority's bank account or a notary account, provided that the beneficiary remains the contracting authority throughout the construction period. The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person performing electrical works, each with the required professional qualification or an equivalent qualification. In addition, the bidder must have the required registry notifications for general construction, indoor climate systems, water supply or sewerage systems within buildings, and electrical works for the construction of electrical installations; this registry requirement does not apply to foreign bidders, but equivalent proof of competence must be provided. The bidder must also have a quality management system compliant with EVS-EN ISO 9001 and an environmental management system compliant with EVS-EN ISO 14001, or equivalent conditions. If the contracting authority cannot verify compliance from public registers, the relevant evidence must be submitted within 10 calendar days.
