Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, human trafficking, tax-related offences or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that the offered goods are not subject to international sanctions and that, in performing the contract, it will not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, as required by the sanctions rules and the tender documents are not empty? Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three financial years completed by the time the procurement was launched must be at least EUR 500,000 per year. The bidder must provide the relevant data in the ESPD and, on request, an extract from the annual accounts or another required proof. If the bidder is not legally required to publish annual accounts in its country of establishment, it must submit an account certified by a notary or other competent official.
Within the 48 months before the contract notice was published, the bidder must have completed at least one or more supply contracts under which a total of at least two rail-track lubrication system equipment sets were sold and installed. At least one installed set must have been placed in Nordic climate conditions with outdoor temperatures ranging from -35 to +45 °C. The bidder must provide, for each contract, a description, total amount, its own scope of responsibility, the contract signing and performance dates, and the client’s contact details; for public procurement contracts, also the reference number. The contracting authority may request confirmation from the client that the contract was properly performed.
The tender must include a technical specification for the lubrication system equipment proving compliance with points 4.2 and 4.3 of the technical description. The tender must be unconditional, and the bidder must confirm compliance with the procurement documents. Where necessary, equivalence must be explained and supporting evidence attached. If the bidder relies on a joint tender or on the resources of another company, the required powers of attorney, ESPDs and other proofs must be submitted. A bidder not registered in the Estonian commercial register must submit an official register extract with an Estonian translation.
