Compliance requirements
The bidder must confirm that none of the exclusion grounds under the Public Procurement Act apply, including the grounds listed in section 95(1) points 1–3 and 5, taking section 95(2) into account. The bidder must also confirm that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been opened against it, its business has not been suspended, and it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, duty or environmental charge arrears, or tax or social security contribution arrears, under the law of its country of establishment. The bidder must confirm that its average employee salary during the reference period was higher than 70% of the average salary in the relevant field for the same period. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure. The bidder must provide a Tax and Customs Board statement or an equivalent certificate from a competent authority in its country of establishment; in a joint tender, the proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. Foreign bidders are exempt from the Estonian registration requirement and may prove equivalent competence with an equivalent document. For electrical works, the bidder must have notified the business register of electrical works covering the construction, including installation, of an electrical installation; foreign bidders may again prove equivalent competence. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value, excluding VAT. The bidder must be able, by the contract date or within 10 calendar days after signing the contract, to provide a performance security equal to 5% of the contract value, either as a bank/financial institution guarantee or by depositing the amount to the beneficiary’s bank account or a notary account, provided the beneficiary remains the entitled party throughout the construction period. The bidder must have completed at least one equivalent construction project within the last 60 months before the procurement was announced, with a value of at least half of the estimated contract value excluding VAT. An equivalent project means construction, extension or full-building reconstruction as the main contractor, including at least structural and external envelope works, mechanical ventilation with heat recovery, and heating system works. The bidder must provide project details, timing, value, and proof of completion by handover certificate or building register reference. The team must include a project manager with at least a level 6 construction engineer qualification specialising in building construction or a level 6 construction manager qualification specialising in general construction; an equivalent qualification is accepted for foreign bidders. The team must also include a site manager with at least a level 5 construction work manager qualification specialising in general construction; an equivalent qualification is accepted for foreign bidders. The team must include a ventilation and heating systems specialist with at least a level 6 heating, ventilation and cooling engineer qualification with competencies in managing heating and ventilation system construction, or a level 6 construction manager qualification specialising in indoor climate systems; an equivalent qualification is accepted for foreign bidders. The team must include a water supply and sewerage systems specialist with at least a level 6 water supply and sewerage engineer qualification with competence in construction management, or a level 6 construction manager qualification specialising in internal or adjacent water supply and sewerage systems; an equivalent qualification is accepted for foreign bidders. For electrical works, the team must include a person with at least a B-class competence certificate or a level 6 electrical engineer qualification in consumer electrical installations; an equivalent qualification is accepted for foreign bidders. The bidder must provide the names and certificate numbers of the relevant team members. The bidder must have a quality management system in the construction field meeting at least EVS-EN ISO 9001 and an environmental management system meeting the required standard; the machine-readable notice did not include the exact environmental standard, so it must be checked in the official tender documents.
