Compliance requirements
The bidder must confirm that none of the statutory exclusion grounds apply, including the grounds listed in the procurement law, bankruptcy or liquidation, suspension of business, and tax or social security debt. The bidder must also confirm that its average wage has been above 70% of the average wage in the relevant field during the reference period, and must provide an extract from the Tax and Customs Board or an equivalent authority for foreign bidders. In addition, the bidder must confirm that it is not a related person to the technical consultant advising the apartment building reconstruction. The exact conditions and the way they are checked must be verified in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided where relevant.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro.
The bidder must confirm that by the contract date at the latest, or within 10 calendar days after contract signature, it can provide a performance-period security equal to 5% of the contract value. The security may be a bank or financial institution guarantee, a deposit to the contracting authority’s account, or a deposit to a notary account, provided that the contracting authority remains the beneficiary throughout the construction period.
Within the last 60 months, the bidder must have completed at least 1 equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the erection, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing and external envelope structures, a heat-recovery mechanical ventilation system, and a heating system. For the reference project, the bidder must provide the building details, the time and value of the work, and proof in the form of a copy of the occupancy notice, occupancy permit or handover-acceptance certificate.
The team must include a project manager with at least level 6 construction engineer qualification specialising in building construction, or level 6 construction manager qualification specialising in general building works. There must also be a site manager with at least level 5 construction foreman qualification specialising in general building works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification, or level 6 construction manager qualification with the relevant specialisation. For electrical works, the team must include a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. All these persons must be involved in the performance of the works, and their names and certificate or competence numbers must be provided.
