Compliance requirements
The contracting authority will exclude a bidder if mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; convictions for unlawful employment of foreigners or breach of conditions for employing foreigners in Estonia; convictions for illegal use of child labour or human trafficking; or tax, fee or environmental charge arrears, or social security contribution arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has provided false information about compliance with qualification requirements or failed to submit requested additional documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
Over the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The bidder must also have a person responsible for managing electrical works with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act; this person must hold the relevant proof at the time of submission and be entered in the EPP environment before bids are opened. In addition, the bidder must have a person with switching rights for switching operations in the 0.22–20 kV electricity network; for low-voltage works only, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. The bidder must also have a person designated as responsible for the work operation, entered in the EPP environment before bids are opened. The bid must include a completed price table and the names, job titles and contact details of the contract signatory and the contact person; if the right of representation does not arise from the articles of association, a power of attorney must be included.
