Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no conviction for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; no conviction for unlawful employment of a foreign national staying without legal basis or for violating the conditions of foreign nationals’ employment in Estonia, including payment below the statutory wage rate; no conviction for illegal use of child labour or human trafficking; and no tax, fee or environmental charge arrears, or social security contribution arrears under the law of the bidder’s country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply, including serious or persistent breach of a previous public contract and false statements or failure to submit required information or additional documents.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of them with a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurement cases, the reference numbers. Upon request by the contracting authority, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major cost. In addition, the bidder must have a person in charge of electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, with the relevant certificate at the time of submission and entered into the EPP environment before opening of tenders. The bidder must also have a person designated as responsible for the work operation with valid rights, entered into the EPP environment before opening of tenders. The bid must include Form 1, the price quotation table, and, where applicable, a power of attorney if the signing authority does not arise from the articles of association.
