Compliance requirements
The bidder is excluded if it is bankrupt or being liquidated, if bankruptcy or liquidation proceedings have been opened against it, if its business activity is suspended, or if it is in a similar situation under the law of its country of establishment. The bidder is also excluded if it has tax, fee, environmental charge, social security or similar payment arrears, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving the relevant notice.
The notice also requires confirmations that the bidder has no exclusion grounds under the specified provisions of the Public Procurement Act, that the average salary of its employees during the reference period was not below 70% of the average salary in the relevant sector, and that the bidder is not a related person to the technical consultant advising the grant recipient on the apartment building reconstruction. If the bidder does not submit the required evidence and the absence of exclusion grounds cannot be checked from public registers, the bidder must provide the documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and water supply or sewerage systems within the building or attached to it. For electrical works, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations. Foreign bidders are exempt from the registration requirement but must prove equivalent competence.
The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be entered to the nearest 1 euro.
Within the 60 months before the start of the procurement, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value. Equivalent work means main contracting for the construction, extension or full reconstruction of a building, including at least the construction or reconstruction of load-bearing and external envelope structures, heat-recovery ventilation, and a new heating system. The bidder must provide the project name, building details, execution time and value, and indicate whether the required work elements were included. Completion must be evidenced by a use notice or use permit number, or by a handover-acceptance report signed by the client and contractor.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, where electrical works are involved, a suitably qualified person. The minimum qualifications are: project manager with construction engineer qualification level 6 or construction manager qualification level 6; site manager with construction foreman qualification level 5; ventilation and heating systems specialist with heating, ventilation and cooling engineer qualification level 6 or construction manager qualification level 6; water supply and sewerage systems specialist with water supply and sewerage engineer qualification level 6 or construction manager qualification level 6; and for electrical works, a class B competence certificate or electrical engineer qualification in consumer electrical installations at level 6. If the bidder relies on the capacities of other persons, signed confirmations of their participation in contract performance must be attached.
