Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or its representative. These grounds cover, among other things, participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking, tax arrears and sanctions violations. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must be entered in the commercial register of its country of establishment, if this is required under that country’s law. An Estonian bidder does not need to submit a register extract, but a foreign bidder must provide a copy of a document proving registration. The bidder and/or its subcontractor must have properly performed at least 1 similar contract completed within the last 60 months before the start of the procurement. A similar contract means a contract for medium- or high-voltage cable installation and/or cable route construction works, including cable installation and connection. Form 2, ‘List of contracts’, must be submitted with the contract name, short description, performance period and the other contracting party. For the performance of the works, the bidder and/or its subcontractor must have qualified responsible personnel. At least one electrical works manager with a Class A competence certificate is required. Copies of documents proving competence must be submitted. If a foreign bidder does not have documents issued in accordance with Estonian requirements, it must submit copies of the documents issued under the laws of its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the competence and qualifications of the above-mentioned responsible person. The bid must comply with the tender documents, be submitted in the required structure, and where necessary equivalence must be explained and supporting evidence attached. In the case of a joint bid, a power of attorney for the joint bidders must be included. Form 1, ‘Bid form’, must also be submitted.
