Compliance requirements

The machine-readable notice includes the standard exclusion grounds from the ESPD, such as participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder must confirm whether any of these grounds apply to the company or its management/representation bodies, and if so provide the required dates, explanations and self-cleaning information. The notice also mentions that subcontractors in the first tier are checked during contract performance, but this is not the bidder’s main exclusion list.

Qualification criteria and exclusion grounds

The bidder must have completed at least 1 similar contract as main contractor within the last 60 months. A similar contract means a contract that included street lighting construction works with at least 20 lighting points. Only works accepted by the client during that period count; the warranty period may still be ongoing. In the ESPD, the bidder must provide the contract subject, the scope of the works performed, the contract period and information about the other contracting parties, including reference numbers in the case of public procurement. At the contracting authority’s request, the successful bidder must provide confirmation from the other contracting party that the contract was performed properly. In addition, the bidder must have a quality management system in the field of construction works that meets at least ISO 9001 requirements or equivalent requirements. If the system is not certified, a description of the company’s internal quality management system must be submitted; the certificate or equivalent documents must be provided at the contracting authority’s request. The tender must comply with the requirements set out in the procurement documents and, where necessary, supporting evidence of equivalence must be attached. If the bidder relies on the resources of another company, that company’s consent and ESPD must be submitted.
