Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds in the Public Procurement Act § 95(1) points 1–5 apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; convictions for enabling illegal work or violating the conditions of employment of a foreign national; convictions for illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where awarding the contract would breach an international sanction or a sanction of the Government of the Republic.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by the laws of that country. A foreign bidder must submit a copy of a valid registration certificate. The bidder or its subcontractor must have performed at least one contract similar to mast maintenance within the last 36 months before the start of the procurement and must provide a list of the main contracts completed during the last 36 months, including their value, dates and the other contracting parties. For the performance of the works, the bidder or its subcontractor must have qualified responsible persons; at least one employee must hold a valid working-at-heights certificate (GWO/IRATA or an equivalent certificate issued by an institution accredited in Estonia or the European Union). A foreign bidder must submit copies of documents proving the qualifications and competence of the responsible persons and, where applicable, a confirmation that it will submit within one month after signing the contract the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
