Compliance requirements
The exclusion grounds include the usual criminal-conviction grounds, such as participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, commission of a terrorist act or offences related to terrorist activity, and the other grounds listed in the ESPD. The bidder or its management board members, procurators or other persons with authority to represent it must not have been finally convicted of these offences within the last 5 years, or the disqualification period stated in the judgment must still apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures if this is permitted. For subcontractors, the bidder must confirm that it will not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s average net turnover over the last 5 financial years must be at least EUR 500,000. This requirement applies to lots 1 and 2. The bidder must provide in the ESPD data on turnover for the last 5 financial years and, at the contracting authority’s request, extracts from the reports of the last three completed financial years if they are not publicly available from a data register. For technical and professional capacity, the bidder must have properly performed at least 2 contracts in the last 60 months for improving the energy efficiency of a publicly used building under reconstruction with a closed net floor area of at least 7,000 m². A list of the contracts must be submitted with the contract conclusion and completion dates, the closed net floor area of the building, and the details of the other contracting party; in addition, letters of confirmation from the clients that the works were carried out properly must be provided. The bid must comply with the procurement documents and, where necessary, equivalent solutions must be explained and evidence of equivalence attached. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid submission form must also be completed in the required format.
