Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud and other standard exclusion grounds. If an exclusion ground applies, the bidder may need to provide evidence of self-cleaning, if allowed by the procurement rules and the tender documents. Qualification criteria and exclusion grounds
Within the 36 months before the start of the procurement, the bidder must have properly performed at least 2 similar contracts concerning the maintenance of green areas and/or landscape-protection maintenance works. The similar contracts must be comparable to this contract in nature and scope. The bidder must provide a description, value, dates and client details for those contracts.
The bidder must involve at least one person who meets the occupational standard “Logger, level 3” or an equivalent qualification. If the person is not from Estonia, evidence of an equivalent right to practise or equivalent professional qualification must be provided. The contracting authority may request a copy of the professional certificate and confirmation that the person will participate in the performance of the contract as a responsible person.
A maintenance quality assurance action plan must be submitted with the tender. It must describe the equipment and tools to be used, the labour needs in different situations, labour substitution arrangements, training and instruction, the qualification of the specialist responsible for day-to-day organisation of the work, and the quality assurance systems used. It must also describe the share of fuel costs for equipment and labour costs in the total contract value.
The tender must comply with the procurement documents and conditional tenders are not allowed. If equivalent solutions or evidence are used, their equivalence must be explained and proved where necessary. In a joint tender, a power of attorney from the joint bidders must be submitted. The bidder must also confirm that it does not use subcontractors among persons subject to replacement under Section 122(7) of the Public Procurement Act and that subcontractors or suppliers linked to the Russian Federation do not account for more than 10% of the contract value. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
