Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no conviction of the bidder or its management/representation persons for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; no conviction for enabling illegal employment of a foreign national or violating conditions of employment of a foreign national in Estonia, including paying less than the statutory wage rate; and no conviction for illegal use of child labour or human trafficking. The bidder must also confirm that it has no tax, duty or environmental charge arrears, or social security contribution arrears under the law of its home country. In addition, the bidder must confirm that none of the optional exclusion grounds apply, including serious or persistent breach of a previous public contract and submission of false information or failure to provide requested documents on qualification. The notice also requires confirmation that the bidder is not established in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence of proper performance.
The bid must include a price table completed in the form provided in the procurement documents. All unit price fields must be filled in.
The bidder’s team must include, before the opening of tenders, a person entered in Elektrilevi’s partner portal with valid switching rights for the 0.22–20 kV electricity network. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are sufficient; in other cases, both low-voltage and medium-voltage switching rights are required.
The bidder must also have a person designated as responsible for the work operation, entered in Elektrilevi’s partner portal before the deadline for submitting tenders.
The bidder’s team must include a person leading electrical works who has valid A-competence or, within the meaning of the Vocational Education Act, at least level 6 qualification, holds the relevant proof at the time of submission, and is entered in Elektrilevi’s partner portal before the deadline.
The bidder must provide the names, job titles and contact details of the person(s) signing the contract, as well as the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included.
The bid must comply with all conditions set out in the procurement documents, and alternative or conditional bids are not allowed.
