Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, tax or social security debt, and the other grounds specified in the tender documents. In a joint bid, each joint bidder is treated as a bidder and the checks apply to all joint bidders. The bidder must also confirm that its average wage during the reference period was more than 70% of the average wage in the relevant field, and provide a Tax and Customs Board extract or an equivalent certificate from the bidder’s home country authority. Qualification criteria and exclusion grounds
The bidder must be registered under the construction activity category for general building works, indoor climate systems, and internal water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In addition, the bidder must accept the condition that by the contract signing date, or within 10 calendar days after signing, it must be able to provide a performance guarantee equal to 5% of the contract value, or deposit the corresponding amount in the beneficiary’s bank account or with a notary.
Within the last 60 months, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, forced ventilation with heat recovery, and a new heating system. The bidder must provide the project name, timing and value, and evidence in the form of a use notice, a building permit number or a handover-acceptance certificate.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a person with the required competence. The project manager must have at least level 6 construction engineer qualification with a specialisation in building construction, or level 6 construction manager qualification with a specialisation in general construction. The site manager must have at least level 5 construction foreman qualification with a specialisation in general construction works. The ventilation and heating systems specialist must have at least level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or level 6 construction manager qualification with a specialisation in indoor climate systems. The water supply and sewerage systems specialist must have at least level 6 water supply and sewerage engineer qualification, or level 6 construction manager qualification with the relevant specialisation. For electrical works, the person must have at least a category B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. The team must also include a level 7 authorised architect responsible for compliance of the design with the European New Bauhaus requirements. The name and qualification or competence certificate number of each person must be provided in the bid.
The bidder must also have a quality management system and an environmental management system for construction activities; the machine-readable notice did not include precise requirements, so these must be checked in the tender documents.
