The contracting authority will exclude a bidder or applicant if any of the exclusion grounds under Section 95(1) points 1–5 of the Public Procurement Act apply. These include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; convictions for enabling the employment of an illegally staying foreign national or breaching the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; convictions for illegal use of child labour or human trafficking; tax, environmental charge, or social security contribution debts; and situations where awarding the contract would breach an international sanction or a Government of the Republic sanction.

The bidder, joint bidder and/or its subcontractor must have completed at least 2 contracts similar to the subject of the procurement during the last 36 months before the start of the procurement. The bidder must submit a list of similar contracts completed by the bidder, joint bidder and/or its subcontractor during the last 36 months before the start of the procurement, including information on their value, dates and the other contracting parties, using the contract list form.
