Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) of the Public Procurement Act apply, for example conviction for certain offences, tax debts, or a sanctions-related obstacle to contract award. The bidder must also confirm that none of the exclusion grounds described in Section 95(4) apply. The contracting authority has set an additional restriction: bids may not be submitted by companies or associations whose place of residence or registered office is in Russia or Belarus; if the bidder is not based in those countries, this question must be answered negatively.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last completed financial year among the last three procurement start dates must be at least EUR 150,000 in total, and turnover data must be provided. The bid must comply with the procurement documents and the technical specification in Annex 1. The bidder must submit the bid price using the form set out in Annex 2 and confirm that the required structure has been used. The bid must be submitted by the bidder’s legal or authorised representative; if necessary, a power of attorney or other proof of representation must be attached. The bidder must be a certified or authorised reseller of Palo Alto products and provide proof of that status. The bidder must also have at least two Palo Alto-certified maintenance engineers, and copies of the certificates or a web link to the certificates must be provided. The bid must include a detailed list of all offered licences with quantities. In the case of a joint bid, an authorised representative must be appointed and a joint-bid power of attorney must be attached. Any trade secrets must be identified and justified in the bid, but the bid price and other numerical indicators related to evaluation may not be marked as trade secrets. If equivalence is relied upon, the relevant evidence must be included.
