Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least 2 similar service contracts during the 36 months before publication of the contract notice. Each contract must have had a value of at least EUR 10,000 excluding VAT. A similar contract means the provision of rental drinking water dispensers with central water systems, including installation, maintenance and repair. For each contract, the bidder must provide information showing similarity, value, dates and the other contracting parties. According to the compliance requirements, the bidder must confirm that the tender complies with the procurement documents, that it has the capacity to provide installation, maintenance and fault-response services, and that compliance of the offered equipment must be demonstrated with Form 1 and relevant product descriptions or technical data sheets. Conditional tenders are not allowed. In the case of a joint tender, a power of attorney must be attached. The bidder must also confirm that the offered goods are not subject to international sanctions and that subcontractors or suppliers linked to the Russian Federation do not account for more than 10% of the contract value.
