Compliance requirements
The bidder must confirm the standard exclusion grounds, including that neither the bidder nor members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or other listed serious offences. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures to restore reliability. For some grounds, the date of conviction, the reason, the convicted person, the duration of exclusion and electronically available evidence must also be provided, if available. The machine-readable notice did not set out all exclusion grounds in full; the exact list must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least one similar service contract within the last 36 months with a value of at least EUR 10,000 excluding VAT. Similar work means installation of traffic counters and transmission of counting data to the client. The bidder must provide the contract subject, reference number, client and contact details, period of performance, and contract value excluding VAT. The work may have started earlier, but it must have been accepted within the required 36-month period. The contracting authority may request a confirmation letter from the client that the reference contract was performed properly; the letter is not required if the client was Tartu City Government. The bidder must have the operating licence or registration required by law for performing the work, if such authorisation is needed for the service. The bidder must also confirm that the offered traffic counters comply with all technical requirements in Annex 5. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must confirm compliance with the tender documents, any equivalence explanations and supporting evidence, the justification for marking trade secrets, and that the offered goods are not subject to international sanctions and do not originate from a sanctioned area.
