Compliance requirements

The bidder may be excluded, for example, if there is a previous contract dispute with Eesti Energia AS or a group company, an unpaid enforceable monetary claim, a breach that led to a contractual penalty or other legal remedies, a breach of ethics or occupational health and safety requirements, a conviction for offences related to corruption, fraud, money laundering or terrorism, submission of false information or forged documents, withdrawal of the bid after the deadline, refusal to sign the contract after being awarded, or failure to submit information and documents requested by the contracting authority. The exact exclusion list should be checked in the tender documents if needed.

Qualification criteria and exclusion grounds

The bidder and/or its subcontractor must have at least one properly performed contract in the last 36 months with a total value of at least EUR 40,000 excluding VAT. The contract must concern mechanical repair works for industrial technological equipment in an operating industrial plant and must have included both assembly and welding work. The bidder must provide the contract title, client, total value, performance period, short description of the work and the client contact person. Experience from multiple contracts may not be aggregated. The bidder and/or its subcontractor must have qualified responsible persons. Required are a welder with certification compliant with EVS-EN ISO 9606-1:2013, at least 5 workers with certificate 111 T FW FM1 ml, and at least 5 workers with certificate 111 T FW FM3 ml. In addition, the following locksmith-related competencies are required: at least 10 locksmiths with hot work permits, at least 6 locksmith-riggers with a valid rigging training certificate, or at least 14 workers with both hot work and rigging permits/certificates if that combination is used. Workers performing hot work must have completed hot work training and hold a valid certificate. If a subcontractor is used, its consent to subcontracting must also be provided, and the subcontractor must be registered so that the contracting authority can check the absence of exclusion grounds. The bidder and/or its subcontractor must also provide the average number of employees, board members and other persons working under contract over the last three years; the average must be at least 15. Supporting documents must be submitted. If the bidder relies on a subcontractor, the subcontractor must be entered in the register. The bidder must also submit the required forms: the contract list form, the list of responsible persons form, the bid price form, and any other required evidence and confirmations. A foreign bidder or foreign subcontractor without Estonian-compliant qualification documents must confirm that it will submit the relevant confirmation from the Consumer Protection and Technical Regulatory Authority within one month after signing the contract.
