Compliance requirements
The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, or if its business activity has been suspended. Exclusion also applies if the bidder has outstanding national tax, fee or environmental charge debts, or tax or social security contribution debts, unless the debt has been deferred or paid. The bidder must confirm that none of the grounds listed in Section 95(1)(1)–(3) and (5) of the Public Procurement Act apply to it and that it is not a related person to the technical consultant advising the contracting authority on the apartment building reconstruction. In the case of a joint bid, these requirements apply to all joint bidders. If the information cannot be checked in public registers, the contracting authority may request evidence issued no more than two weeks before the deadline for submitting tenders.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. If electrical works are to be carried out, the bidder must also have a registration for electrical works covering the construction and installation of electrical installations; the registration requirement does not apply to foreign bidders, but they must prove equivalent competence. The bidder’s net turnover for the financial year preceding the submission of the tender must be at least equal to twice the estimated value of the contract excluding VAT. The bidder must confirm that it can provide a 5% construction-period guarantee letter or equivalent security, and that the security will remain valid for the entire construction period. Within the last 60 months, the bidder must have completed at least one comparable construction project as the main contractor, with a value of at least half of the estimated contract value; the comparable project must involve the erection, extension or full reconstruction of a building and include at least construction or reconstruction of load-bearing and external envelope structures, construction or reconstruction of heat-recovery mechanical ventilation, or construction or reconstruction of a new heating system. To prove this, the bidder must provide the project name, building details, execution period and value, and indicate whether the project met the required scope; acceptable proof includes the number of the occupancy notice or occupancy permit, or a handover-acceptance report signed by the client and contractor. The team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and, for electrical works, a person with the required competence; their qualifications must meet the required professional certificates or equivalent competence. If the bidder relies on the capacities of other persons, signed commitments from those persons to participate in contract performance must be attached.
