Compliance requirements
The bidder is excluded if the bidder, or a member of its management, administrative or supervisory body, a proxy holder or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling illegal employment of a foreign national, illegal use of child labour, human trafficking, or tax debt. The contracting authority may also exclude a bidder that has materially breached a previous contract or has submitted false information about qualification or failed to provide the requested data and documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of them with a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the contact details of the other contracting party and, in public procurement cases, the reference numbers; the contracting authority may also request evidence of proper performance. The bid must comply with all tender document requirements and include the price table, completed with all unit prices. The bidder must have a worker with valid switching authorisations for 0.22–20 kV electrical networks; for low-voltage works, at least low-voltage switching authorisations are sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required. Before the opening of bids, the EPP system must already include the person responsible for the work operation (C-person) and the person leading electrical work, who must have a valid A-competence or at least level 6 qualification under the Vocational Qualifications Act and the relevant certificate. The bidder must provide the names and contact details of the contract signatory and the contact person, and a power of attorney if the signing authority does not arise from the articles of association. The bid must also identify any trade secrets and complete the required confirmation forms. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
