Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: convictions related to criminal organisation, corruption, money laundering or terrorist financing, convictions related to enabling illegal employment or the use of child labour, tax debt, status as a subject of international sanctions, or any other grounds listed in Section 95(1) of the Public Procurement Act. The bidder must also confirm that none of the voluntary exclusion grounds apply, such as bankruptcy, serious professional misconduct, anti-competitive agreements, conflicts of interest, material breach of previous contracts, submission of false information, or tax offences. The machine-readable notice did not include precise exclusion grounds; they must be checked in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must have at least three properly completed contracts for roof construction and/or repair works within the 60 months preceding the start of the procurement. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details, telephone number and email address), and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance of those contracts.
For the tender, a properly completed price table must be submitted for the relevant lot. The tender must comply with all conditions set out in the procurement documents, and conditional tenders are not allowed.
For managing the construction activity, the bidder must have a construction engineer or construction manager at qualification level 6, or a person managing construction works with at least an equivalent qualification under the Professional Qualifications Act. For preparing the building design, the bidder must have a certified construction engineer at level 7, or a general construction designer with at least an equivalent qualification. A copy of the professional certificate must be submitted for both roles.
To carry out the works, a person responsible for the work operation, i.e. a C-person, must be appointed and entered into Elektrilevi’s Partner Portal (EPP) before performance of the contract begins. The bidder must confirm that it will use Elektrilevi’s EPP environment when performing the contract. In the case of a joint tender, a power of attorney from the joint bidders must be attached.
During the works, materials, equipment and goods, including components, that are produced in or originate from the Russian Federation or the Republic of Belarus may not be used. The contracting authority may request certificates of origin. The machine-readable notice did not include precise qualification or compliance requirements; they must be checked in the procurement documents.
