Compliance requirements
The bidder must not have the exclusion grounds listed in Section 95(1) points 1-5 and Section 95(4) point 12 of the Public Procurement Act. The bidder must confirm the absence of these grounds in the public procurement register. If there are other persons in the bidder’s company who may represent the company, make decisions on its behalf or control it and who are not visible from the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
Within the 36 months before the tender notice publication date, the bidder must have completed at least 1 contract under which it carried out technical condition surveys of port structures worth at least EUR 30,000 excluding VAT. The contract may have started before that period or end after it, but only the part completed within the last 36 months counts. The bidder must submit the contract details on the form provided by the contracting authority (Annex 3). If the bidder relies on another company’s resources, it must submit that company’s consent on Annex 5 and add the relevant subcontractor and reliance confirmation to the tender. In a joint tender, Annex 6 must also be submitted if the joint bidders rely on each other’s resources. The person responsible for the technical surveys must hold at least level 7 professional qualification of a chartered civil engineer with specialisation in port construction, in the occupation of design of port structures or design management, or an equivalent qualification. The bidder must provide the responsible person’s details and, if necessary, copies of documents proving the qualification.
