The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent, decide on behalf of, or control the bidder, has been convicted of participation in a criminal organisation, breach of the duty of honesty, corruption, fraud, a terrorist offence or incitement, aiding or attempted aiding of such an offence, money laundering or terrorist financing. Exclusion also applies if such persons have been convicted of enabling work for a foreigner staying in the country without legal basis or of violating the conditions for employing a foreigner in Estonia, including paying less than the statutory wage rate, or of illegal use of child labour or human trafficking. The bidder is also excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of an earlier public contract, if the breach led to withdrawal from the contract, termination, price reduction, damages or a contractual penalty, or if false information was provided about compliance with qualification requirements or requested additional documents were not submitted. The notice also includes confirmations that the bidder is not established in Russia or Belarus and that the materials, equipment and goods used in the works, including components, are not produced in or originating from Russia or Belarus.

The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties' contact details (including the client representative's phone number and email address) and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were performed properly, unless the contracting authority can obtain the information from public or its own databases without significant cost. The machine-readable notice also requires a person with valid switching rights for 0.22–20 kV networks, a responsible person for the work operation (C-person), and a person managing electrical works with valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, all entered in the EPP environment before opening of tenders. The bidder must also confirm representation authority, submit the names and contact details of the signatory and contact person, and include a power of attorney if authority does not arise from the articles of association.
