Compliance requirements

The bidder must not be subject to the mandatory exclusion grounds: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment in Estonia or violating the conditions for employing a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply: serious or persistent breach of an earlier public contract and submission of false information or failure to provide required documents. In addition, the bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of those contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence of proper performance. A completed pricing table must be submitted with the tender. The bidder must have a person in charge of electrical works with valid A-level competence or at least level 6 qualification under the Vocational Qualifications Act, who has the relevant proof at the time of tender submission and is entered in the EPP environment before tender opening. The bidder must also have a worker with switching rights for switching operations related to works in the 0.22–20 kV electricity network; if only low-voltage works are procured, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. The bidder must also have a person designated as responsible for the work operation, entered in the EPP environment before tender opening. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The bidder must also indicate any business secret in the tender and justify why it is treated as a business secret.
