Compliance requirements
Before awarding the contract, the contracting authority will check whether the bidder has any exclusion grounds referred to in sections 95(1) and 95(4) of the Public Procurement Act. The bidder must confirm that none of those exclusion grounds apply. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least 3 contracts equivalent to the subject of this tender within the last 3 years. An equivalent contract means a service, rental or sales contract for goods similar to the items in the lot. A list of completed contracts must be provided, including the client, contact details, contract period, subject and description of the contract, and the contract value; if a public procurement reference number exists, it must also be included. To prove technical compliance, the bidder must submit Appendix 2, the technical specification, showing the manufacturer, model and brand of each product in a clear and understandable way. If the bidder relies on equivalence, it must explain this where necessary and attach proof. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid must be valid for 3 months, and if the bid is successful, the bidder must provide the contract signatory details and the bidder’s contact person for contract performance. The bidder must also confirm compliance with the tender documents, that any trade secret has been identified and justified where applicable, and that the offered goods are not subject to international sanctions or originate from sanctioned areas.
