Compliance requirements

The contracting authority will exclude a bidder if the exclusion grounds under § 95(1) of the Public Procurement Act apply to the bidder or to any entity whose resources the bidder relies on. The bidder must confirm that such grounds do not exist; if the answer is no, the bidder must describe the applicable exclusion grounds. The contracting authority may also exclude a bidder if the exclusion ground under § 95(4)(8) applies, namely breach of previous public contracts. The bidder must confirm that this ground does not exist; if the answer is no, the bidder must describe the contract breaches, including contract details and the circumstances of the breach. Bidders whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate. This also applies to any entity whose qualification the bidder relies on under § 103(1).

Qualification criteria and exclusion grounds

The bidder must have had annual net turnover of at least EUR 150,000 in each of the last three completed financial years before the start of the procurement. For a calendar-year financial year, these are 2025, 2024 and 2023. The bidder must also have completed at least two construction contracts similar to the subject of the procurement within the 60 months before the contract notice was published. A similar contract means a construction contract where the bidder acted as main contractor or contractor, the works were carried out on a building, part of a building or building complex of at least 1,000 m² of enclosed net area, and the works included installation of a new access control and video surveillance system. The bidder must submit Form 1 with the required turnover and reference data. If the bidder relies on another entity’s resources for experience, that entity must perform the relevant part personally. If requested, the bidder must also provide a client confirmation letter showing that the works were performed properly. For the project manager, the bidder must involve a construction works project manager with responsibility in the field of fire and security alarm systems and either a professional certificate of Security Systems Responsible Specialist, Level 5 (or equivalent) or Security Systems Designer, Level 6 (or equivalent). If the certificate was issued outside Estonia, copies of the relevant qualification document and an Estonian authority’s document confirming equivalence must be submitted. The bidder must submit Form 4 for the specialist. If the bidder submits a joint tender, Form 8 on authorisation and joint and several liability must be provided. The tenderer must also submit Form 2, Form 3 and, if applicable, documents on equivalent solutions and equipment documents on request.
