Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, unlawful employment of foreigners, child labour or human trafficking. The bidder must also not have tax, duty or environmental charge arrears, or social security contribution arrears under the law of the country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract, or that has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details and, in the case of public procurement, the reference numbers. On request, evidence of proper performance of the similar electrical construction contracts must be provided.
The bid must comply with all conditions set out in the procurement documents, and alternative or conditional bids are not allowed. The bid price must be submitted in the required table, and all unit price fields must be completed.
For switching work in the 0.22–20 kV electricity network, the bidder must have an employee with valid switching rights who has been entered into Elektrilevi’s partner portal before the opening of bids. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are sufficient; in other cases, both low-voltage and medium-voltage switching rights are required. There must also be a person with valid rights designated as responsible for the work operation, and that person must be entered into the EPP environment before the opening of bids.
The bidder must have a lead electrical works person with valid A-competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, with the relevant certificate at the time of bid submission and entered into the EPP environment before the opening of bids. The signatory of the contract and the contact person must be named, and if the right of representation does not arise from the articles of association, a power of attorney must be included.
The bidder must confirm that the materials, equipment and goods used in the works, including components, are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin. The bidder must also state any business secret or confirm that the bid does not contain one.
