Compliance requirements
The mandatory exclusion grounds cover criminal offences involving participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorist offences or incitement/complicity/attempt, money laundering and terrorist financing. The bidder is also excluded if its representatives or controlling persons have been convicted for enabling work for an alien staying illegally in the country or for violating the conditions for employing foreigners in Estonia, including paying less than the statutory wage rate, or for illegal use of child labour or human trafficking. Another mandatory ground is tax, duty or environmental charge arrears, or tax/social security contribution arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, or if the bidder has submitted false information about qualification or failed to provide required supporting documents. The bidder must confirm that none of these mandatory or voluntary exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed, unless the contracting authority can obtain the information from public or its own databases without significant cost. The team must include a person with valid A-competence or, under the Vocational Professions Act, at least level 6 qualification for managing electrical works; this person must have the relevant proof at the time of submitting the bid and must be entered in Elektrilevi’s partner portal before the bid deadline. There must also be a person responsible for the work operation, entered in the partner portal before the bid deadline. The bid must include the price table in the prescribed form and all unit price fields must be completed. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must comply with all tender document requirements and conditional bids are not allowed.
