Compliance requirements
The bidder must confirm that neither it nor its management or representative persons have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, or any other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The same criminal exclusion grounds apply to first-tier subcontractors, and subcontractors must submit the ESPD.
Qualification criteria and exclusion grounds
The bidder must submit an application to participate in the tender and a confirmation of bid validity in Form I. The bid must comply with the technical specification and include the rental price for VMware licences in Form IV. The bidder must be an authorised reseller of the offered licence and must provide a valid manufacturer confirmation or a public verification link; if representation rights are proven through a cooperation partner, both the manufacturer’s confirmation of the partner’s representation rights and the partner’s confirmation of cooperation with the bidder must be provided. Where applicable, a power of attorney in Form V must be included. Joint bidders must submit a power of attorney for the authorised representative under Form II and a joint-bidder declaration on joint and several liability in Form III. The bid must include subcontractor information and a free-form declaration that subcontractors, suppliers or entities from the Russian Federation will not be engaged for more than 10% of the contract value and that their capabilities will not be relied upon for meeting the selection criteria. The machine-readable notice did not include precise additional selection or compliance requirements; these must be checked in the tender documents.
