Compliance requirements

The bidder must confirm that there are no exclusion grounds, including that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been opened against it, and its business has not been suspended. The bidder must also confirm that it has no tax, fee or social security contribution debts, unless the debt has been deferred, paid, or will be settled or deferred within 10 calendar days after notice. The bidder must confirm that the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act do not apply, and that the required general declaration document is included in the tender. The bidder must provide Tax and Customs Board certificates for itself, all joint bidders and subcontractors named in the tender showing that the average wage of their employees was not below 70% of the average wage in the relevant sector during the reference period, unless the entity has no employees. The bidder must also confirm that it is not a related person to the technical consultant advising the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works, including the construction and installation of electrical installations. Foreign bidders are exempt from the registration requirement but must prove equivalent competence. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value excluding VAT. In a joint tender, this requirement must be met by at least one joint bidder on its own; turnovers may not be aggregated. The bidder must have submitted the annual report for the calendar year preceding the tender submission year, if the reporting obligation had already arisen. If the report has not been submitted and there is no legal basis for the omission, the bidder will be excluded from the procedure. The bidder must be able to provide a performance bond amounting to 5% of the contract value. The bond must be confirmed by a credit or financial institution and remain valid throughout the construction period. It may also be provided by depositing the corresponding amount into the contracting authority’s or a notary’s account, provided that the contracting authority is the entitled beneficiary throughout the construction period. Within the last 60 months, the bidder must have carried out at least one equivalent construction project with a value of at least half of the expected contract value. An equivalent project means the main contractor’s construction, extension, or full-building reconstruction of a building, including at least the construction or reconstruction of load-bearing and external envelope structures, forced ventilation with heat recovery, and a new heating system. To prove this, the bidder must provide at least the building details, the time and value of the work, and information on the type of project. The tender must include the completed tender form, the total price in accordance with the procurement documents, any required equivalence explanations and evidence, and, in the case of a joint tender, a power of attorney. If team members are persons who are not employees of the bidder and are not listed in the register as competent persons, their written consent to participate in the team must be attached.
