Compliance requirements

The mandatory exclusion grounds cover criminal offences involving participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing. They also cover offences related to enabling illegal work for a foreign national staying without legal basis, enabling breach of the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, and offences related to illegal use of child labour or human trafficking. In addition, a bidder may be excluded if it has tax, duty or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The bidder must confirm that none of these mandatory grounds apply. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, if the breach led to termination, withdrawal, price reduction, compensation of damage or a contractual penalty, or if the bidder has submitted false information about compliance with qualification requirements or failed to submit required additional documents.

Qualification criteria and exclusion grounds

Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided. The bidder must also have a person in charge of electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act; this person must hold the relevant certificate at the time of submission and be entered in the EPP environment before the opening of tenders. The bidder must have a worker with switching rights for switching operations in the 0.22–20 kV electricity network; for low-voltage works only, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. A person responsible for the work operation must also be designated and entered in the EPP environment before the opening of tenders. The tender must include a completed price table, the details of the contract signatory or signatories, and, where applicable, a power of attorney if the signing authority does not arise from the articles of association.
